1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the website moschovakiscapital.com (the “Site”) and all services, products, and content provided by Moschovakis Capital (“we,” “us,” or “our”), including but not limited to algorithmic trading software, equity research publications, and related educational content (collectively, the “Services”).
By accessing our Site or purchasing any of our Services, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must not access or use our Services.
2. Nature of Services
2.1 Technology Provider
Moschovakis Capital is a technology provider and publisher. We are NOT a licensed financial advisor, broker-dealer, investment firm, or portfolio manager. We do not hold a license from the Hellenic Capital Market Commission (HCMC), the Financial Conduct Authority (FCA), the Cyprus Securities and Exchange Commission (CySEC), or any other financial regulatory authority.
2.2 No Financial Advice
Nothing on this Site or in our Services constitutes financial advice, investment advice, trading advice, or any other form of professional advice. All content, including but not limited to algorithmic trading software, equity research publications, trade ideas, market commentary, and performance data, is provided strictly for informational and educational purposes only.
Any trading or investment decisions you make are solely your responsibility. You should consult with a qualified, licensed financial advisor before making any investment decisions.
2.3 What We Provide
Our Services include access to proprietary algorithmic trading software (Expert Advisors) designed for the MetaTrader 4 and MetaTrader 5 platforms, equity research publications and stock analysis, copy trading services through authorized third-party platforms, and access to our membership community (Capital Club), where applicable based on your subscription tier.
3. Subscription and Payment
3.1 Pricing
Subscription pricing is as listed on our Site at the time of purchase. We reserve the right to modify pricing at any time. Any price changes will not affect active subscriptions until the next billing cycle after notice has been given.
3.2 Billing
Subscriptions are billed on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize us to charge the payment method on file for all applicable fees on each billing date.
3.3 Refund Policy
We offer a 30-day satisfaction guarantee. If you are not satisfied with our Services within the first 30 days of your initial subscription, you may request a full refund by contacting us at info@moschovakiscapital.com. After the initial 30-day period, all payments are non-refundable. Refunds are not available for partial months of service.
3.4 Cancellation
You may cancel your subscription at any time by contacting us at info@moschovakiscapital.com or through the account management options available on the Site. Upon cancellation, you will retain access to your subscription tier until the end of the current billing period. No further charges will be made after cancellation takes effect.
4. User Obligations
By using our Services, you represent and warrant that: you are at least 18 years of age, you have the legal capacity to enter into a binding agreement, you will provide accurate and complete information when creating an account or subscribing, you will not redistribute, resell, share, or sublicense our proprietary software, research, or any content provided through our Services, you will not attempt to reverse-engineer, decompile, or disassemble our algorithmic trading software, you will not use our Services for any unlawful purpose or in violation of any applicable laws or regulations, and you are solely responsible for the security of your trading account credentials and any activity that occurs under your account.
5. Intellectual Property
All content, software, algorithms, research publications, trademarks, logos, and other intellectual property associated with Moschovakis Capital and our Services are owned by or licensed to us and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use our Services for your personal, non-commercial use during the term of your active subscription.
You may not copy, modify, distribute, sell, or lease any part of our Services or intellectual property without our prior written consent.
6. Risk Disclosure
Trading and investing in financial instruments, including but not limited to foreign exchange (forex), equities, derivatives, and other securities, involves substantial risk of loss and is not suitable for all investors. You should carefully consider your investment objectives, level of experience, and risk appetite before using our Services.
Past performance is not indicative of future results. Historical performance data, including results displayed on third-party verification platforms such as Myfxbook, represents past performance under specific market conditions and does not guarantee or predict future performance.
You acknowledge and agree that: you may lose some or all of your invested capital, leveraged trading carries additional risk and can result in losses exceeding your initial deposit, market conditions may change in ways that adversely affect the performance of any trading algorithm, no trading system or algorithm is infallible, and Moschovakis Capital bears no responsibility for any trading losses incurred through the use of our Services.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Moschovakis Capital and its owners, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, trading losses, or business interruption, arising out of or related to your use of or inability to use our Services.
Our total aggregate liability to you for any claims arising from or related to these Terms or our Services shall not exceed the total amount of fees you have paid to us during the twelve (12) months immediately preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Moschovakis Capital, its owners, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any applicable laws or the rights of any third party.
9. Third-Party Services
Our Services may integrate with or reference third-party platforms, including MetaTrader 4/5, Myfxbook, Stripe, and Social Trader Tools. We are not responsible for the availability, accuracy, or functionality of any third-party services. Your use of third-party services is governed by their respective terms and conditions.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Material changes will be communicated via email to active subscribers. Your continued use of our Services after any modifications constitutes acceptance of the updated Terms.
11. Termination
We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent or illegal activity, redistribution of our proprietary content, or abusive behavior toward our staff or community members. Upon termination, your license to use our Services immediately ceases.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Greece, without regard to conflict of law principles. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.
Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a minimum period of thirty (30) days.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
